🕓 LATE CHECK-OUT

A late check-out can be requested and must be agreed with our staff at the time of boat delivery and, in any case, before departure.

In the event of returning the boat after the agreed time, a penalty of €30 for every half hour or fraction of a half hour of delay will apply.

📍 BOAT DELIVERY

For full-day rentals, boat delivery takes place between 09:00 and 09:45.

For afternoon half-day rentals, delivery normally takes place between 14:00 and 14:15.

In case of delay, the customer must notify our staff in advance. Without prior notice, after the maximum delivery time our staff may leave the departure point and delivery may only be possible later, subject to staff availability and with a possible additional charge.

📌 BOAT LOCATION

The exact location of the boat and directions to the delivery point will be sent via WhatsApp on the day before the rental to the telephone number provided during the booking.

Once you arrive at the pier, please contact +39 335 65 65 940 for assistance and to proceed with the boat handover.

🌧️ BAD WEATHER POLICY

The decision as to whether the rental can take place in adverse weather conditions is made exclusively by Nautica Bibione, based on the weather conditions and the safety of navigation.

In the event of persistent rain from the morning onwards which is expected to continue for more than half a day, if Nautica Bibione considers that the trip cannot reasonably be carried out in suitable conditions, the amount paid at the time of booking will not be lost.

In this case, the amount paid may:

• be used to arrange the rental on another available date; or
• be refunded to the original payment method upon the customer's request.

The mere presence of rain, isolated thunderstorms, cloud cover or rainfall lasting less than half a day does not automatically entitle the customer to a refund.

In all other cases, the General Rental Conditions published on the website and forming an integral part of the rental agreement shall apply.

GENERAL CONDITIONS FOR THE RENTAL OF A PLEASURE CRAFT WITHOUT CREW OR SKIPPER

These General Conditions govern the rental without crew or skipper of pleasure craft operated by Nautica Bibione S.n.c. and form an integral part of the booking conditions and the rental agreement signed by the renter.

The rental without crew or skipper means that the craft is made available to the renter for the agreed period without any crew member or skipper provided by Nautica Bibione. During the rental period, the renter assumes responsibility for operating and navigating the craft in compliance with applicable laws, the onboard documentation, the technical characteristics of the craft and these conditions.

1. Purpose of the rental

Nautica Bibione grants the renter the right to use the pleasure craft specified in the booking and rental agreement for the agreed period and under the agreed conditions.

The rental concerns exclusively the use of the craft without a skipper, driver or crew provided by Nautica Bibione.

2. Booking

The booking is considered confirmed according to the procedures indicated at the time of booking and following payment of the required amount.

Confirmation of the booking constitutes acceptance of these General Conditions and of the specific conditions indicated in the booking confirmation.

3. Amount paid at the time of booking

The amount paid at the time of booking constitutes a payment on account of the rental fee, unless the agreement or booking confirmation expressly specifies a different legal nature for the amount.

Payment of the deposit does not alter the renter's obligations under the rental agreement and these conditions.

4. Balance of the rental fee

The remaining balance must be paid within the terms indicated in the booking confirmation and, in any case, before delivery of the craft, unless otherwise agreed in writing with Nautica Bibione.

5. Renter's documents

At the time of delivery, the renter must present a valid identity document. Where required by applicable law, the renter must also present a valid boating licence appropriate for operating the rented craft.

Nautica Bibione may request verification of the relevant documents before delivery of the craft.

6. Requirements for operating the craft

The renter declares that they possess the knowledge, experience and, where required, the appropriate qualification necessary to operate the craft safely.

The renter must comply with all regulations concerning navigation safety, pleasure craft operation and the use of the boat.

7. Instructions before departure

Before departure, Nautica Bibione provides the renter with the necessary information and instructions regarding the use of the craft, the main safety equipment, controls, engine, emergency procedures and any navigation restrictions.

The renter must carefully follow these instructions and ask for clarification before departure if they do not fully understand the operation of the craft or its equipment.

8. Delivery of the craft

The craft is delivered in working order and with the equipment required by applicable regulations and the craft's documentation.

At the time of delivery, the renter must check the general condition of the boat, engine, equipment and accessories and immediately report any problems before departure.

9. Delivery times

For full-day rentals, delivery normally takes place between 09:00 and 09:45.

For afternoon rentals, delivery normally takes place between 14:00 and 14:15.

The customer must respect the agreed time and promptly notify Nautica Bibione of any delay.

10. Customer's delay in taking delivery

In the event of a delay without prior notice, Nautica Bibione may no longer be present at the delivery point.

If delivery can nevertheless be carried out, it will take place subject to staff availability and an additional charge may apply, which will be communicated to the customer.

11. Delivery location

The boats are delivered at a private pier located along the Tagliamento River, on the Bibione side.

For organisational and safety reasons, the exact delivery location is not published on the website.

12. Communication of the location

On the day before the rental, the customer will receive a WhatsApp message containing the exact location of the delivery point and the necessary directions to reach it.

The telephone number used will be the one provided by the customer during the booking.

13. Contact at the pier

Once at the pier, the customer must contact Nautica Bibione at +39 335 65 65 940 for the boat handover procedures.

14. Rental period

The rental period is the one indicated in the booking confirmation and rental agreement. The renter may not use the craft beyond the agreed period without prior authorisation from Nautica Bibione.

15. Daily operating times

The standard operating times for rentals are:

• Full day: 09:00 to 17:30;
• Half day morning: 09:00 to 12:30;
• Half day afternoon: 14:00 to 17:30.

16. Return of the craft

The renter must return the craft to the agreed location and at the agreed time, in the same condition in which it was delivered, except for normal wear resulting from proper use of the craft.

Before returning the craft, the renter must check that no personal belongings have been left on board and must return all keys, equipment and accessories received.

17. Late return

Failure to respect the agreed return time may result in a charge of €30 for every half hour or fraction of a half hour of delay, unless otherwise provided by the agreement or applicable law.

Unauthorised delay does not in any case entitle the renter to use the craft beyond the agreed rental period without the consent of Nautica Bibione.

18. Extension of the return time

Any extension of the return time must be agreed in advance with Nautica Bibione and is subject to the availability of the craft and organisational requirements.

The renter may not consider an extension automatically authorised simply by notifying Nautica Bibione of a delay.

19. Fuel

The craft is delivered with a full fuel tank.

The renter must return the craft with the fuel tank full again. Fuel consumed during the rental is the responsibility of the renter.

20. Navigation limits

The renter must comply with the navigation limits indicated in the craft's documentation, the boating licence where applicable, the instructions provided and these conditions.

Unless otherwise specifically indicated by Nautica Bibione, navigation is permitted only within the limits applicable to the craft and in compliance with restrictions concerning distance from the coast, prohibited areas, speed limits and all regulations issued by the relevant maritime and local authorities.

21. Navigation in lagoons and inland waters

Navigation in lagoons and inland waters must be carried out in full compliance with speed limits, local regulations, navigable channels and any prohibited or restricted areas.

In lagoon areas, an appropriate speed must be maintained according to the navigation conditions and within the limits established by the applicable regulations.

22. Prohibition of navigation in the Venice Lagoon

Navigation in the Venice Lagoon is not permitted with the craft covered by these rental agreements, unless expressly authorised in advance and all required permits have been obtained.

23. Maximum number of persons on board

The number of people on board may never exceed the maximum number authorised for the craft and indicated in the onboard documentation and booking confirmation.

The renter is responsible for ensuring compliance with this limit throughout the rental period.

24. Safety of persons on board

The renter is responsible for the correct use of safety equipment and must take all necessary precautions to protect everyone on board.

Safety equipment must be used according to the instructions provided and may not be removed, damaged or used for purposes other than those intended.

25. Conduct during navigation

The renter must navigate prudently, taking into account weather conditions, sea conditions, visibility, other vessel traffic, the presence of swimmers and obstacles, and any other circumstance relevant to navigation safety.

Any reckless, dangerous or inappropriate use of the craft is prohibited.

26. Prohibited uses

The following are prohibited:

• using the craft for purposes other than recreational boating;
• transferring or subletting the craft to third parties;
• allowing unauthorised persons to operate the craft;
• exceeding the maximum authorised number of persons on board;
• using the craft in weather or sea conditions incompatible with safe navigation;
• using the craft for unauthorised commercial or professional activities;
• carrying out dangerous activities or activities not permitted by the craft's documentation;
• modifying or tampering with the engine, systems, equipment or onboard instruments.

27. Prohibition of tampering with GPS and tracking systems

The craft may be equipped with GPS and tracking or monitoring devices.

It is expressly prohibited to deactivate, disconnect, obstruct, damage or tamper with such devices. Any attempt to interfere with their operation constitutes a breach of the contractual obligations and may result in a claim for compensation for any resulting damage or costs incurred, within the limits permitted by law.

28. Damage, accidents and breakdowns

The renter must immediately notify Nautica Bibione of any accident, collision, impact, grounding, breakdown, damage or other circumstance that may have affected the craft, engine, equipment or the safety of persons on board.

In an emergency, the renter must first take all necessary measures to ensure the safety of persons and contact the relevant authorities when necessary, informing Nautica Bibione as soon as possible thereafter.

29. Grounding and damage resulting from improper operation

In the event of grounding, contact with the seabed, obstacles, rocks, mooring posts, piers or other structures, the renter must stop navigation when necessary to prevent further damage and immediately contact Nautica Bibione.

Costs resulting from damage caused by wilful misconduct, negligence, recklessness or conduct contrary to the instructions and conditions of use shall be charged to the responsible party, within the limits provided by law and the rental agreement.

30. Assistance in the event of breakdown

In the event of a breakdown, the renter must contact Nautica Bibione before independently arranging repairs or interventions on the engine or craft, except where immediate action is necessary to ensure the safety of persons.

The renter is not authorised to independently appoint workshops or technicians for work to be charged to Nautica Bibione without prior authorisation, except in emergencies where the intervention is essential to prevent greater damage.

31. Damage to equipment and accessories

The renter must take proper care of the craft, keys, equipment, accessories and any other material received.

Any loss, damage or breakage attributable to the renter may be charged according to the actual cost of repair, replacement or restoration, within the limits provided by law and the rental agreement.

32. Insurance

The craft is insured in accordance with the applicable insurance policy.

The conditions, deductibles, exclusions and any coverage limits are those established by the insurance policy and the rental agreement.

Any insurance deductible payable by the renter, where applicable, will be expressly indicated in the rental agreement or booking confirmation.

33. Cancellation by the customer

The customer may request cancellation of the booking up to 4 (four) days before the scheduled start date of the rental.

The cancellation request must be communicated to Nautica Bibione in writing by email or by another agreed means of communication.

If cancellation is communicated within the deadline of 4 (four) days before the rental start date, the amount already paid at the time of booking will be refunded to the customer.

For cancellations communicated during the 3 (three) days preceding the rental start date, or on the rental date itself, the amount already paid will not be refunded.

The statutory right of withdrawal provided for by the Italian Consumer Code for distance contracts does not apply to this rental, as the service concerns a leisure activity with a specific date or period of performance, pursuant to Article 59(1)(n) of Legislative Decree 206/2005 (Italian Consumer Code).

The provisions of point 34 concerning cancellation or modification of the rental due to adverse weather conditions remain unaffected.

34. Bad weather and weather conditions

Navigation is subject to weather and sea conditions and to the safety assessment carried out by Nautica Bibione.

Nautica Bibione has exclusive authority to assess and decide whether weather conditions are such that the rental cannot safely take place. The mere occurrence of rain, isolated thunderstorms, cloud cover, wind or temporary worsening of weather conditions does not automatically give the customer the right to a refund.

If Nautica Bibione determines that, due to persistent rain from the morning onwards which is expected to continue for more than half a day, it is not reasonably possible to carry out the trip in suitable conditions, the amount paid at the time of booking will not be lost.

In such circumstances, the customer may, by agreement with Nautica Bibione:

• use the amount paid to arrange a new rental on another available date; or
• request a refund of the amount paid to the original payment method.

The decision to apply this procedure rests exclusively with Nautica Bibione and is based on the actual weather conditions and the safety of navigation.

In all other cases, including limited or temporary rainfall, changing weather conditions during the day or situations in which Nautica Bibione considers that the rental can nevertheless take place safely, the amount paid at the time of booking will not be refunded solely because of rain.

35. Inability to deliver the craft for reasons attributable to Nautica Bibione

If, due to an unforeseen circumstance not attributable to the customer, the craft is unavailable or a technical problem prevents delivery, Nautica Bibione will promptly inform the customer.

Where possible, Nautica Bibione may offer a replacement craft with comparable characteristics, an alternative available date or another solution agreed with the customer.

If no acceptable alternative solution can be found, any amounts due will be refunded in accordance with applicable law and the rental agreement.

36. Voluntary termination of the trip during the rental

Once the craft has been delivered and the rental has begun, the renter's personal decision to terminate the trip or return early, for reasons other than weather or technical conditions recognised by Nautica Bibione, does not automatically give the renter the right to a refund of the amount paid.

37. Personal belongings

Nautica Bibione is not responsible for the loss, theft or damage of personal belongings left on board by the renter or passengers, except in cases where liability is imposed by law.

The renter is responsible for retrieving all personal belongings before returning the craft.

38. Personal data

Personal data provided by the customer is processed in accordance with applicable data protection legislation and the information provided in Nautica Bibione's privacy policy.

Data may be used, within the limits permitted by law, for booking management, the conclusion and performance of the rental agreement, administrative and tax requirements, obligations arising from boating regulations and necessary communications relating to the rental.

39. Acceptance of the conditions

By making a booking, the customer declares that they have read and accepted these General Rental Conditions and undertakes to comply with them throughout the contractual relationship.

The renter also declares that they have received or are able to access the information necessary concerning the use of the craft and the main safety rules.

40. Applicable law and disputes

The rental agreement is governed by Italian law, without prejudice to any mandatory provisions that may apply to consumers.

For matters not expressly covered by the rental agreement and these conditions, the provisions of the Italian Recreational Boating Code, the Italian Navigation Code, the Italian Civil Code, the Italian Consumer Code where applicable, and other applicable legislation shall apply.

Any disputes shall be subject to the jurisdiction rules provided for by applicable law, without prejudice to any mandatory rights granted to consumers.

41. Validity of the conditions

If one or more provisions of these General Conditions are found to be invalid, ineffective or unenforceable, this shall not automatically result in the invalidity or ineffectiveness of the remaining provisions, which shall remain valid and effective to the extent permitted by law.

These General Conditions form an integral part of the rental agreement and apply together with the specific conditions indicated in the booking and in the rental agreement signed by the renter.
